Curfews

Reminder
Faribault police would like to remind parents that Faribault City Ordinance (Chapter 17, Article II) prohibits anyone under the age of 18 years to remain in any public place or on the premises of any establishment within the city during curfew hours. Curfew hours are 11 p.m. on any Sunday, Monday, Tuesday, Wednesday, or Thursday until 6 a.m. of the following day; and 12:01 a.m. until 6 a.m. on any Saturday or Sunday.

Enforcement
When enforcing the curfew ordinance, the main concern of the Faribault Police Department is for the safety and welfare of our children. Children who are out during curfew and are not accompanied by a parent or guardian run an increased risk of being victimized or getting involved in illegal behavior such as vandalism, theft, tobacco, alcohol and drug use.

It is a violation for any parent or guardian of a minor to knowingly permit, or by insufficient control allow, the minor to remain in any public place or on the premises of any establishment within the city during curfew hours. The term "knowingly" includes knowledge which a parent or guardian should reasonably be expected to have concerning the whereabouts of a minor in the legal custody of that parent or guardian.

It is also unlawful for any owner, operator, or any employee of an establishment to knowingly allow a minor to remain upon the premises of the establishment during curfew hours.

Exceptions
The city ordinance allows for a few exceptions for curfew. These, among others, include being engaged in an employment activity, or going to or returning home from an employment activity, without any detour or stop. Also while attending an official school, religious, or other recreational activity supervised by adults and sponsored by the city, a civic organization, or another similar entity that takes responsibility for the minor, or going to or returning home from, without any detour or stop, an official school, religious, or other recreational activity supervised by adults and sponsored by the city, a civic organization, or another similar entity that takes responsibility for the minor.

A person who violates a provision of this article is guilty of a separate offense for each day or part of a day during which the violation is committed, continued, or permitted.

Penalties
Curfew violators are subject to a fine not to exceed $200.

When a Faribault police officer arrests a juvenile for a curfew violation, they will take the juvenile to the police department, issue a citation requiring a court appearance, and then notify the juvenile's parents to come to the Faribault Police Department to pick their child up.
